Who we are
Diamond Peak Real Estate (“we”, “us”) is an estate agency in Pretoria North, run by Mari Nolle. We are the responsible party for your personal information under the Protection of Personal Information Act 4 of 2013 (POPIA).
Mari Nolle, Information Officer, Diamond Peak Real Estate. physical address, Pretoria North. Phone 084 048 6837, email info@diamondpeak.co.za.
What we collect
- When you contact us (phone, WhatsApp, email or the enquiry form): your name, phone number, email address and what you’re looking for.
- When you sell or let through us: the property’s address and details, photos, and the price or rent you want.
- When you buy or rent through us: what you need for the deal, such as your ID, proof of address, marital status and, if you need a bond, the details your bank or bond originator asks for.
- When you visit the website: our host keeps basic technical logs (like your IP address and browser) to keep the site running and safe, and cookies show us how the site is used and help us show you our ads. See the cookie policy.
We collect this from you directly. Sometimes we get it from someone acting for you, like your attorney, bank or the other party’s agent.
Why we use it
- To answer your enquiry and arrange viewings.
- To value, market, sell or let your property.
- To prepare offers, leases and the paperwork for transfer.
- To meet the law: estate agents must check who their clients are (the Financial Intelligence Centre Act 38 of 2001, “FICA”) and follow the Property Practitioners Act 22 of 2019.
- Only if you say yes: to send you new homes that match what you want.
Do you have to give it?
Your contact details are up to you, but without them we can’t reply. For a sale or rental, FICA documents are required by law: without them the deal can’t go ahead.
Information stored outside South Africa
Some of the services we use, like email and website hosting, may store information on servers outside South Africa. We only use providers in countries with similar privacy laws, or who are bound by an agreement to protect it, as section 72 of POPIA requires.
Marketing messages
We only send you property news by email, SMS or WhatsApp if you said yes, or if you’re already our client and it’s about similar services. Every message says who it’s from and how to stop it. Reply “stop” or email us and we’ll stop, free of charge.
How long we keep it
- Enquiries that don’t lead to a deal: deleted after 12 months.
- Records of a sale or rental, including FICA documents: at least five years after the deal, because the law requires it.
- Marketing list: until you ask us to stop.
Keeping it safe
Accounts are protected with strong passwords and two-step login, the website runs on a secure connection (https), and paper documents are locked away. If your information is ever accessed by someone who shouldn’t have it, we’ll tell you and the Information Regulator as soon as we reasonably can (POPIA section 22).
Your rights
Under POPIA you can:
- ask if we have information about you, and get a copy (see our PAIA manual)
- ask us to correct it, or delete it if we no longer need it
- object to how we use it, and say no to marketing at any time
- complain to the Information Regulator
To do any of this, contact Mari Nolle on 084 048 6837 or info@diamondpeak.co.za. If you’re not happy with our answer, you can complain to the Information Regulator, Woodmead North Office Park, 54 Maxwell Drive, Woodmead, Johannesburg, 2191. Phone 010 023 5200 or toll-free 0800 017 160. Email POPIAComplaints@inforegulator.org.za (privacy complaints) or enquiries@inforegulator.org.za. Website inforegulator.org.za.
Children
Our services are for adults. We don’t knowingly collect information about children, except where a child is part of a household in a lease or sale and the law requires it.
